This Privacy Policy explains how NXTLVL Coaching LLC ("NXTLVL," "we," "us," or "our") collects, uses, and protects your information when you use the NXTLVL mobile application (the "App"). By using the App, you agree to the practices described here.
1. Who We Are
The App is operated by NXTLVL Coaching LLC, a limited liability company organized under the laws of the State of Texas, United States. We are the data controller for the personal information processed through the App. You can reach us at support@nxtlvl.coach.
2. Eligibility
The App is intended only for individuals who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has provided us information, contact us and we will delete it.
3. Information We Collect
We collect the following categories of information so the App can deliver personalized coaching:

| Generated content | The meal plans, workout programs, and coaching insights the App creates for you. |
| AI Chat content | Messages you send to, and receive from, the in-app AI coach. |
| Usage and activity | In-app activity such as completed workouts, streaks, mood check-ins, and feature usage. |
| Device and technical data | Device identifiers, push notification tokens, app version, and diagnostic or crash data used to keep the App stable. |
| Subscription status | Whether you have an active subscription or trial, and related purchase history, received from Apple and our subscription provider. We do not collect or store your payment card or bank details. |
4. How We Use Your Information
- To generate and adjust your personalized meal plans, workout programs, and coaching insights.
- To power the in-app AI coach and respond to your messages.
- To create and maintain your account and manage your subscription and free trial.
- To send you notifications you have enabled, such as reminders and re-engagement messages.
- To monitor, secure, troubleshoot, and improve the App.
- To comply with legal obligations and enforce our Terms of Use.
5. AI Processing Disclosure
NXTLVL is powered by artificial intelligence. To build your plan, swap meals and exercises, write your daily insight, and respond in the AI Chat, certain inputs are transmitted to and processed by our third-party AI provider, Google LLC, through the Gemini API, acting as a processor on our behalf. We access the Gemini API through a Google Cloud project with active billing, which Google's Gemini API Additional Terms define as a Paid Service. We send Google only what each feature needs. To build your meal plan: your biological sex, fitness goal, meals per day, dietary preferences and food allergens, and the daily calorie and macronutrient targets we calculate for you. We calculate those targets ourselves from your height, weight, age, sex, and activity level, and those underlying values are not sent to Google. In the AI Chat: the message you send, up to your last ten chat messages, and the profile details used to personalize replies: your first name, goal, experience level, training days, workout program name, meal plan targets, dietary preferences, and current streak. When you swap a meal: the meal being replaced, your goal, and your dietary preferences and allergens. When you swap an exercise: the exercise being replaced, your equipment, experience level, and any injury areas you reported. For your daily insight: your goal, experience level, program name, streak, and calorie target. Under Google's terms for Paid Services, Google does not use these prompts or responses to improve its products and processes them under Google's Data Processing Addendum for Products Where Google is a Data Processor. Google does log prompts and responses for a limited period of time, solely to detect and prevent violations of its Prohibited Use Policy and for any required legal or regulatory disclosures. Google's terms do not state a fixed retention period for that logging, and state that this data may be stored transiently or cached in any country in which Google or its agents maintain facilities.
Please do not enter sensitive personal information, medical records, financial account details, or information about other people into the AI Chat. AI-generated responses are produced automatically and are described further in our Terms of Use.
6. Service Providers We Share Data With
We do not sell your personal information. We share information only with the service providers that make the App work, and only as needed to provide the service:
- Google Firebase (Google LLC): authentication, database storage, file storage, hosting, serverless functions, analytics, crash reporting, and push notification delivery.
- Google (Gemini API) (Google LLC): processing of the inputs listed in Section 5 to generate AI plans, meal and exercise swaps, daily insights, and chat responses. Under Google's Paid Services terms, Google does not use this data to improve its products, but does log it for a limited period for abuse prevention and legal compliance, as described in Section 5.
- RevenueCat (RevenueCat, Inc.): management of subscription status and entitlements.
- Apple (Apple Inc.): App Store distribution, processing of all purchases and refunds, and Sign in with Apple.
Each provider processes data under its own privacy terms. We may also disclose information if required by law, to protect our rights, or in connection with a merger, acquisition, or sale of assets.
7. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the App. When you request deletion, we delete or anonymize your personal data within a reasonable period, except where we are required to retain certain records to comply with law, resolve disputes, or enforce our agreements.
8. Your Rights
Depending on where you live, you may have the following rights over your personal information:
Right of access and data portability (GDPR Article 15)
You may request a copy of the personal information we hold about you. We provide a data export on request so you can review or move your data.
Right to erasure (GDPR Article 17)
You may request deletion of your account and personal information. You can delete your account from within the App, or by emailing support@nxtlvl.coach. Data export and account deletion are handled as separate requests.
Other rights
You may also have rights to correct inaccurate data, restrict or object to certain processing, and withdraw consent. If you are a California resident, you have the right to know what personal information we collect and to request its deletion, and we do not sell your personal information. 9. Data Security
We use reasonable administrative and technical safeguards to protect your information, including encryption of data in transit and server-side access rules that restrict each user's data to that user. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. International Data Transfers
We are based in the United States, and the information we collect is processed and stored in the United States and in the regions used by our service providers. If you access the App from outside the United States, you understand your information will be transferred to and processed in the United States.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after an update means you accept the revised policy.
